These Terms of Service govern your use of hamiltonpavilions.com (the “Site”), operated by Ferd Wolfson, Inc., doing business as Hamilton Jewelers Pavilions (“Hamilton Jewelers,” “we,” “us,” or “our”), located at 504 Pavilions Lane, Sacramento, CA 95825. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The Site presents our jewelry and timepiece collections for your browsing. We do not sell directly through the Site at this time. Every item is available by inquiry, and purchases are completed by phone or in our showroom. An “Inquire” request through the Site is a request for information, not an order, and it creates no obligation on either side until we confirm a sale with you.

We make every effort to display our jewelry and timepieces accurately. Colors, scale, and finish may vary slightly between the photograph and the piece because of monitor settings and the handmade nature of fine jewelry. Carat weights, dimensions, and metal weights are approximate unless a grading report states otherwise.

Prices, where shown, are in U.S. dollars, exclude shipping and applicable taxes, and are subject to change without notice. Gold, platinum, and diamond prices move with the market, and the price we quote at the time of sale is the price that applies. Availability shown on the Site is not guaranteed; a piece may sell in the showroom before we respond to your inquiry.

Contact us by phone at (916) 927-2300, by email at info@hamiltonpavilions.com, through the inquiry form on any product page, or in our showroom. We accept all major credit cards. We do not offer financing at this time. We verify identity and billing details before shipping any purchase.

Hamilton Jewelers is an authorized retailer for Cartier, IWC Schaffhausen, Panerai, and Breitling, and for every designer brand shown on the Site. Every item we sell is new and authentic, supplied directly by the brand or its authorized distributor, and comes with the manufacturer’s warranty and documentation. Watch warranties are activated in our showroom in the purchaser’s name.

Custom-designed pieces, special orders, engraving, and sizing require a 20% deposit at the time of order. We provide a written design or order confirmation, and production begins once you approve it. Custom and personalized items are final sale, as described in our Return and Exchange Policy.

Shipping terms for purchases we ship are set out in our Shipping Policy. Returns and exchanges are governed by our Return and Exchange Policy. Warranty coverage and repair terms are described in our Warranty and Repair Policy. Each of those policies is part of these Terms.

All content on the Site, including text, photographs, logos, product designs, and the Hamilton Jewelers name, belongs to Hamilton Jewelers or its licensors and is protected by U.S. and international copyright and trademark law. Brand names and logos of the manufacturers and designers we carry belong to their respective owners. You may not copy, reproduce, or distribute Site content without our written permission.

You agree not to use the Site to violate any law, infringe anyone’s rights, submit false information, interfere with the Site’s operation, scrape or harvest data, or attempt to gain unauthorized access to any system. We may block access for any breach of these Terms.

Information you submit through an inquiry form is handled as described in our Privacy Policy. Any review, comment, photo, or other material you submit to the Site may be used by Hamilton Jewelers in any medium without compensation. You confirm that your submissions are your own, do not infringe anyone’s rights, and contain nothing unlawful or offensive. We may remove any submission at our discretion.

Except as expressly stated in our Warranty and Repair Policy and the manufacturer’s written warranty, the Site and all products are provided “as is.” To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some states do not allow these exclusions, so some of them may not apply to you.

To the fullest extent permitted by law, Hamilton Jewelers is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any product, and our total liability for any claim is limited to the amount you paid for the product at issue.

You agree to indemnify and hold harmless Hamilton Jewelers and its owners, employees, and agents from any claim or expense, including reasonable attorneys’ fees, arising from your breach of these Terms or your misuse of the Site.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction. Nothing in this section limits any rights you have under California consumer protection law.

We may update these Terms at any time by posting a revised version on the Site with a new “Last updated” date. Your continued use of the Site after a change means you accept the revised Terms. If we begin selling directly through the Site, we will update these Terms and our policies before doing so.
